Code of Ethics

All CACAP accredited members and appointed neutrals are required to adhere to our Code of Ethics, which establishes the professional standards and responsibilities expected of practitioners in dispute resolution.

Core Principles

The Code of Ethics is founded on the following core principles:

  • Independence and Impartiality: Neutrals must maintain independence from all parties and avoid any appearance of bias or conflict of interest.
  • Confidentiality: All proceedings and communications are conducted in strict confidence, unless otherwise required by law or agreed by the parties.
  • Competence: Practitioners must maintain professional competence and expertise appropriate to their accreditation discipline.
  • Integrity: Practitioners must conduct themselves with the highest standards of honesty, integrity, and professional conduct.
  • Fairness: All parties must be treated fairly and be given equal opportunity to present their case.
  • Diligence: Proceedings must be conducted promptly and efficiently, respecting the time and resources of all parties.

Continuing Professional Development

CACAP is committed to supporting the ongoing professional development of accredited members. As the dispute resolution landscape evolves, practitioners must maintain and enhance their knowledge and skills.

CPD Requirements

CACAP may introduce continuing professional development requirements as a condition of maintaining accredited status. Members will be notified of any such requirements with reasonable advance notice.

Development Opportunities

CACAP provides accredited members with access to:

  • Specialist training courses and seminars on emerging dispute resolution issues
  • Networking events and forums for knowledge sharing and peer learning
  • Updates on developments in construction law, contract administration, and dispute resolution practice
  • Resources and publications supporting professional practice
  • Mentoring and professional guidance from senior practitioners

Professional Obligations

CACAP accredited members are required to:

  1. Maintain Accreditation Status: Ensure continued compliance with the Terms of the Accreditation Scheme and all applicable rules and standards.
  2. Disclose Conflicts: Promptly disclose any potential conflicts of interest to the parties and to CACAP when required.
  3. Update Professional Details: Keep professional details and contact information current in the CACAP panel register.
  4. Professional Conduct: Maintain the highest standards of professional conduct and refrain from conduct that brings CACAP or the profession into disrepute.
  5. Compliance with Rules: Comply with applicable dispute resolution rules, procedures, and legal requirements in conducting proceedings.
  6. Continuing Learning: Engage in ongoing professional development and maintain current knowledge of relevant law and practice standards.
