Nomination refers to the process by which an appointing authority assists parties in selecting qualified neutrals for dispute resolution.

CACAP provides nomination services for arbitrators, mediators, expert determiners, expert witnesses, and dispute board members. The Centre maintains a diverse panel of specialists across multiple disciplines and expertise areas.

Process

CACAP's nomination process is designed to facilitate efficient and impartial selection of qualified neutrals across all dispute resolution services. The process commences when parties submit a request for nomination to the Centre. The request should include details of the dispute or matter, the required expertise and qualifications, any selection criteria agreed by the parties, and disclosure of any potential conflicts of interest.

The Centre reviews its comprehensive panel to identify candidates whose qualifications, experience, and expertise match the requirements of the parties. The Centre considers the technical and professional requirements of the matter, the nature and complexity of the dispute, the geographical location and any language requirements, and the parties' preferences regarding the neutral.

Comprehensive conflict checks are conducted to ensure that nominated candidates are independent and impartial, free from conflicts of interest, and available to undertake the appointment. The Centre then proposes suitable candidates to the parties for their consideration and agreement, or, where authorised as an appointing authority, directly appoints the neutral.

Upon appointment, the Centre issues formal confirmation, and the neutral assumes responsibility for their role in the dispute resolution process. All subsequent procedural matters are managed directly between the parties and the appointed neutral, in accordance with the agreed dispute resolution procedures or rules.

CACAP's role in the nomination process is to facilitate the selection and appointment of qualified, independent, and impartial neutrals. Once appointed, the Centre does not administer the dispute resolution proceedings or participate in the conduct or substance of the dispute. The Centre's involvement concludes upon appointment, unless further appointment functions are required.

Nomination services are subject to the Centre's schedule of nomination fees, which are available on request from the Secretariat at secretariat@cacap.asia.
