Arbitration Process

Step 1: Request for Appointment

A party or parties submit a request to the Centre, providing details of the dispute, the expertise required, and any potential conflicts of interest.

Step 2: Nomination and Appointment

The Centre reviews its panel of accredited arbitrators, conducts conflict-of-interest checks, and proposes or appoints a qualified arbitrator or tribunal. Confirmation is issued upon acceptance.

Step 3: Commencement of Proceedings

The appointed arbitrator or tribunal assumes responsibility for the conduct of the arbitration in accordance with the applicable rules. Where the parties have elected Centre administration, the Centre provides administrative support throughout the proceedings.

Step 4: Conduct of Proceedings

The tribunal manages all aspects of the proceedings, including submissions, evidence, and hearings. The Centre's administrative role, if engaged, supports procedural matters without involvement in the substance of the dispute.

Step 5: Award

The tribunal issues a binding award, enforceable internationally under the New York Convention. The Centre does not review the substance of awards.

Step 6: Post-Award Matters

Parties may request the Centre's assistance for replacement of arbitrators, challenges, or related procedural matters.

Mediation Process

Step 1: Request for Appointment

A party or parties submit a request, providing details of the dispute, required mediator expertise, and any potential conflicts.

Step 2: Nomination and Appointment

The Centre reviews its panel, conducts conflict checks, and proposes or appoints a qualified mediator. Confirmation is issued upon acceptance.

Step 3: Commencement of Mediation

The appointed mediator assumes responsibility for the mediation process in accordance with the parties' agreed rules or procedures.

Step 4: Mediation Process

The mediator facilitates discussions, joint and private sessions, and negotiations to assist parties in reaching a voluntary settlement. The process is confidential.

Step 5: Outcome

Where agreement is reached, the parties execute a settlement agreement. Where agreement is not reached, the mediation concludes without a binding determination.

Step 6: Post-Appointment Matters

Parties may request the Centre's assistance to replace a mediator if necessary.

Expert Determination Process

Step 1: Request for Appointment

Step 2: Nomination and Appointment

The Centre reviews its panel, conducts conflict checks, and proposes or appoints a qualified expert determiner. Confirmation is issued upon acceptance.

Step 3: Commencement of Determination

The appointed expert assumes responsibility for the determination in accordance with the parties' agreed rules or procedures.

Step 4: Determination Process

The expert manages submissions, inspections, meetings, and the evaluation of evidence independently.

Step 5: Determination

The expert issues a binding determination directly to the parties.

Step 6: Post-Appointment Matters

Parties may request the Centre's assistance to replace the expert if necessary.

Expert Witness Nomination

Step 1: Request for Nomination

A party submits a request specifying the required expertise, qualifications, and the nature of the proceedings.

Step 2: Nomination

The Centre reviews its panel, conducts conflict checks, and nominates suitable expert witnesses for the party's consideration.

Step 3: Direct Engagement

The party engages the nominated expert directly. Terms, fees, and instructions are agreed between the party and the expert.

Step 4: Independent Expert Work

The expert carries out their work independently, preparing expert reports and opinion evidence as instructed.

Step 5: Conclusion

The expert's engagement concludes in accordance with the terms agreed between the party and the expert. The Centre has no ongoing involvement.

Dispute Board Appointment

Step 1: Request for Appointment

A party or parties submit a request, providing project details, the type of board, the number of members required, expertise needed, and any potential conflicts.

Step 2: Nomination and Appointment

The Centre reviews its panel, conducts conflict checks, and proposes or appoints qualified dispute board members. Confirmation is issued upon acceptance.

Step 3: Commencement of Operations

The appointed board assumes responsibility for dispute board operations in accordance with the contract and agreed rules.

Step 4: Board Operations

The board manages site visits, project meetings, dispute hearings, and issues recommendations or decisions independently.

Step 5: Post-Appointment Matters

Parties may request the Centre's assistance to replace a board member if necessary.

Nomination Service Process

Step 1: Request for Nomination

A party or parties submit a request, providing details of the dispute, the type of neutral required, expertise needed, and any potential conflicts.

Step 2: Nomination and Appointment

The Centre reviews its panel, conducts conflict checks, and proposes or appoints a qualified neutral. Confirmation is issued upon acceptance.

Step 3: Commencement of Proceedings

The appointed neutral assumes responsibility for the conduct of proceedings in accordance with the parties' agreed rules.

Step 4: Post-Appointment Matters

Parties may request the Centre's assistance with challenges, replacements, or procedural matters.
